1. Reporting Copyright Infringement

Guidecall respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on guidecall.app infringes a copyright you own or control, you may send a written notice to our designated agent using the contact information below. We will respond to properly submitted notices in accordance with the DMCA, which may include removing or disabling access to the material and, in appropriate circumstances, terminating the accounts of repeat infringers.

3. How to File a Notice

To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and include substantially the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material you believe is infringing, with enough detail (such as the URL) for us to locate it.
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Under Section 512(f), you may be liable for damages (including costs and attorneys' fees) if you knowingly misrepresent that material is infringing.

4. Counter-Notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may send a counter-notification to the designated agent above. To be effective under 17 U.S.C. § 512(g), it must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before it was removed.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which Guidecall may be found), and that you will accept service of process from the party who filed the original notice or its agent.

5. Repeat Infringers

Guidecall will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
