Trip Participant Liability Waiver, Release & Assumption of Risk

This Liability Waiver, Release, and Assumption of Risk (this "Agreement") is made by the undersigned participant ("Participant," "I," or "me") in connection with a fishing trip, charter, or related activity (the "Activity") booked through the Guidecall platform operated by Guidecall LLC ("Guidecall"). The Activity is provided by an independent fishing guide or Charter Captain (the "Guide"). Guidecall is only a technology platform; it is not the provider of the Activity, it does not own or operate any vessel, and it does not supervise the Activity. In exchange for being permitted to participate, I agree as follows.

1. Released Parties

"Released Parties" means Guidecall LLC and its owners, members, officers, employees, and affiliates, and the Guide and his or her Captain, crew, owners, and affiliates.

2. Acknowledgment and Assumption of Inherent Risks

I understand that fishing, boating, and related outdoor activities are inherently dangerous and can cause serious injury, illness, permanent disability, or death. These risks include, without limitation: drowning and near-drowning; slips and falls on wet or moving surfaces; capsizing, collision, grounding, or sinking; sudden or severe weather, waves, currents, and temperature extremes; hooks, knives, lines, gear, and machinery; contact with fish, marine life, or wildlife; sun exposure, dehydration, and seasickness; remoteness from medical care and delays in rescue; the conduct of the Guide, crew, other passengers, and third parties; equipment failure; and errors, delays, or miscommunications in the booking or scheduling process. I knowingly and voluntarily assume all such risks, whether known or unknown.

3. Release and Waiver of Liability

To the fullest extent permitted by law, I release, waive, and discharge the Released Parties from any and all claims, demands, causes of action, damages, and liabilities of any kind — including for personal injury, death, illness, property damage or loss, economic loss, emotional distress, loss of enjoyment, and any direct, indirect, incidental, or consequential damages — arising out of or related to the Activity, including those arising from the ordinary negligence of the Released Parties, except to the extent prohibited by applicable law or caused by a Released Party's gross negligence, recklessness, or willful misconduct.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claim, liability, damage, loss, cost, or expense (including reasonable attorneys' fees and costs) brought by me, on my behalf, by any member of my party for whom I am responsible, or by any third party, arising out of or related to the Activity or my breach of this Agreement, except to the extent caused by the gross negligence, recklessness, or willful misconduct of a Released Party.

5. Medical Fitness and Representations

I represent that I am at least 18 years of age (or, if under 18, that my parent or legal guardian has signed this Agreement on my behalf); that I am physically able to participate in the Activity; that I have disclosed to the Guide any medical condition, limitation, allergy, or medication that could affect my safety; that I will promptly inform the Guide of any change; and that I will not participate while impaired by alcohol, drugs, or any prescription or over-the-counter medication that may affect my judgment, balance, or physical capacity.

6. Rules, Instructions, and Safety Equipment

I agree to follow all instructions and safety directions of the Guide and Captain, to wear or use safety equipment (including a personal flotation device) as directed or required, and to conduct myself safely at all times. The Guide and Captain have sole authority to modify, delay, relocate, or cancel the Activity for safety reasons.

7. No Insurance Provided

I understand that the Released Parties do not provide medical, disability, life, or personal-property insurance covering me. Guidecall makes no representation regarding whether the Guide carries liability, marine, or other insurance. I am responsible for obtaining my own insurance.

8. Media Release

I grant Guidecall and the Guide an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, and publish photographs, video, or other media taken during the Activity, including my name, likeness, and voice, to operate, promote, and advertise their services in any medium, without compensation or further approval required.

9. Minors

If the Participant is under 18 years old, the parent or legal guardian signing on the minor's behalf personally agrees to all terms of this Agreement on behalf of both the minor and the parent/guardian individually, assumes the inherent risks on the minor's behalf, and agrees to personally release and indemnify the Released Parties — including for any claims brought by or on behalf of the minor — to the fullest extent permitted by law.

10. Governing Law; Severability; Entire Agreement

This Agreement is governed by the laws of the State of New Jersey and applicable federal maritime law. If any provision is held unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be enforced to the maximum extent permitted by law. This Agreement supplements Guidecall's Terms of Service (the terms and conditions governing use of the Guidecall platform, as may be amended from time to time) and is the entire agreement regarding its subject matter.

11. Acknowledgment

I have read this Agreement, I understand it, and I sign it freely and voluntarily. I have had the opportunity to consult with an attorney before signing. I understand that I am giving up substantial legal rights, including the right to sue. My electronic acceptance (checking the waiver box at booking, or signing my name through a Guidecall signing link) constitutes my signature on this Agreement.
